AGREEMENT

between the Government of the Russian Federation and
the Government of the Republic of Tatarstan on military issues

The Government of the Russian Federation and the Government of the Republic of Tatarstan, further referred to as the Sides,
guided by the Constitution of the Russian Federation and the Constitution of the Republic of Tatarstan and by the Treaty on Delimitation of Powers and Delegation of Authority between Bodies of State Power of the Russian Federation and the Republic of Tatarstan, signed on February 15, 1994,
and understanding the importance of the matters related to defense and security of the Russian Federation and the Republic of Tatarstan, agree on the following:

Article 1

Issues related to defense and security of the Russian Federation and the Republic of Tatarstan, including those of military service in the Armed Forces of the Russian Federation, training of personnel for the Armed Forces of the Russian Federation, payments of pensions to the retired servicemen, as well as the exercise of rights and privileges established for servicemen and members of their families, are under the jurisdiction of the Russian Federation.
Issues related to the organization of training for military mobilization of the economy of the Republic of Tatarstan, location of military bases and institutions of the Armed Forces of the Russian Federation on the territory of the Republic of Tatarstan, as well as issues of staffing and quotas for the citizens of the Republic of Tatarstan, are under the joint jurisdiction of the Russian Federation and the Republic of Tatarstan.
Issues under the joint jurisdiction of the Russian Federation and the Republic of Tatarstan are regulated by the legal acts of the Russian Federation which do not contradict the Constitution and other legal acts of the Republic of Tatarstan.

Article 2

The Government of the Republic of Tatarstan through plenipotentiary representatives in the Government of the Russian Federation shall participate in the development of the military doctrine of the Russian Federation.

Article 3

Land on which military bases and institutions of the Armed Forces of the Russian Federation are located, as well as other parcels of land used for military purposes in the Republic of Tatarstan, are property of the Republic of Tatarstan.
Military bases and institutions of the Russian Federation located on the territory of the Republic of Tatarstan shall not be relocated.
With the consent of the Government of the Republic of Tatarstan, land can be allocated for the Ministry of Defense of the Russian Federation to be used in military purposes except for testing of all kinds of mass destruction weapons.
All property and other assets of the Armed Forces of the Russian Federation built and/or obtained by the Ministry of Defense of the Russian Federation is considered federal property and shall be used in accordance with its designation. Responsibility for maintenance of military sites rests with the Command of military bases and institutions of the Armed Forces of the Russian Federation.
Damage to the economy of the Republic of Tatarstan inflicted by the activities of military bases and institutions of the Armed Forces of the Russian Federation shall be compensated by resources of the Russian Federation.

Article 4

The Government of the Republic of Tatarstan guarantees that servicemen of the Armed Forces of the Russian Federation and persons retired from active duty, as well as members of their families who are located on the territory of the Republic of Tatarstan, shall enjoy rights, freedoms and privileges established for them by the legislation of the Russian Federation. The Government of the Republic of Tatarstan may establish additional rights, freedoms and privileges for servicemen of the Armed Forces of the Russian Federation as well as members of their families. Servicemen serving in the military bases and institutions located on the territory of the Republic of Tatarstan may upon completion of their term choose the Republic of Tatarstan or any other location as a place of residence.
The Government of the Republic of Tatarstan shall provide servicemen who choose the territory of the Republic of Tatarstan as place of residence with housing, medical service, and other services in accordance with the legislation of the Russian Federation.

Article 5

Location of military bases and institutions of the Armed Forces of the Russian Federation on the territory of the Republic of Tatarstan, their withdrawal from the Republic of Tatarstan, export of material goods produced with the participation of the Republic of Tatarstan as well as transport of nuclear, chemical and other weapons of mass destruction through the territory of the Republic of Tatarstan, shall be conducted with the consent of the Government of the Republic of Tatarstan.
The Command of the military bases and institutions of the Armed Forces of the Russian Federation located on the territory of the Republic of Tatarstan shall notify the Government of the Republic of Tatarstan well in advance about large-scale military exercises on the territory of the Republic of Tatarstan. The Command shall notify the Government of the Republic of Tatarstan about military movements of regiments and larger groups on the territory of the Republic of Tatarstan.

Article 6

The Military Commissar of the Republic of Tatarstan, commanders of military educational institutions on the territory of the Republic of Tatarstan, as well as the Commander of the Kazan garrison shall be appointed upon the consent of the Government of the Republic of Tatarstan.

Article 7

The Command of the military bases and institutions located on the territory of the Republic of Tatarstan is not allowed to interfere in the internal affairs of the Republic of Tatarstan by use of force or by threat to use force.
The Republic of Tatarstan in its turn shall prevent any illegal actions against military bases, servicemen and members of their families.

Article 8

Citizens of the Republic of Tatarstan shall be drafted for the service in the Armed Forces of the Russian Federation in accordance with plans and quotas approved by the Government of the Russian Federation.
Citizens of the Republic of Tatarstan can be called up for the service in the military formations of the Russian Federation located beyond the Russian Federation only on a voluntary basis.

Article 9

The Government of the Republic of Tatarstan guarantees the provision of necessary material and food resources as well as of water, natural gas, electricity and other supplies to military bases and institutions on the territory of the Republic of Tatarstan. The Government of the Republic of Tatarstan shall place orders and allocate financial means designated for housing construction for servicemen, retired servicemen and their families.

Article 10

The Government of the Russian Federation shall allocate financial means for the implementation of social and economic programs for military bases and institutions located on the territory of the Republic of Tatarstan as well as for the pensions and privileges fund established by the legislation of the Russian Federation for servicemen, retired servicemen and members of their families.

Article 11

Working groups composed of representatives of state representative bodies of the Republic of Tatarstan may be formed in order to monitor the conditions by which citizens of the Republic of Tatarstan enter military service with visits to the military bases and institutions where citizens of the Republic of Tatarstan serve.
The Sides shall jointly resolve cases of desertion.

Article 12

The Sides shall conduct consultations for the review of issues related to the implementation of clauses of the Agreement.

Article 13
The Agreement is concluded for the term of five years and shall be automatically prolonged for another term unless one of the Sides notifies the other in a written form six months in advance of expiration about its intention to annul the Agreement.
The Agreement was signed and initialed in Moscow on March 5, 1994.
